The terms and conditions set forth below (the “General Conditions”) regulate the relationship between the companyM3 SPORTS & COACHING, L., withCIF B86724937 and address inDelco Street 5, Leganes, 28915, Madrid (Spain), in particular in relation to its sports programme activity International Padel Week and International Padel Week-end in M3 Padel Academy(hereinafter collectively referred to as “User”).
All persons who have a formal contract with the company will be considered users. M3 Padel Academy, the object of which is the paid use of the services offered by M3 Padel Academy (the “Services”).
- ACCEPTANCE OF THESE GENERAL CONDITIONS
Acceptance of this document implies that the User: (i) has read, understands and comprehends these General Conditions; (ii) is a natural person with sufficient capacity to contract and meets the legal conditions to enter into the contract carried out through the Web; (iii) assumes each and every one of the obligations established herein, which will regulate this purchase process, and (iv) understands and accepts the rules of use and operation ofM3 Padel Academy(included in this document).
Registration implies acceptance of the rules and regulations of use established by M3 Padel Academy.
The User knows and accepts the content of these General Conditions established, and that non-compliance with them, or any other internal or general regulations that may be applicable, or indication made by the Staff ofM3 Padel Academy, may lead, as a consequence, to the discharge and expulsion of M3 Padel Academy.
The quality of User ofM3 Padel AcademyIt is obtained by formalizing the registration and making the payment for the experience.
Registration as a User ofM3 Padel Academycovers the contractual relationship for the period for which the receipt is paid.
The User knows and accepts thatM3 Padel Academymay establish and/or modify limitations on the registration of persons in the Center.
You can register atM3 Padel AcademyThose who prove to be over sixteen (16) years old.
Unemancipated minors over sixteen (16) years of age may register and use the facilities under the following conditions:
- The registration application and these General Conditions must be signed by the father, mother or legal guardian and a photocopy of their ID must be attached.
- By signing this document, the person signing as a father, mother or legal guardian is responsible for all the acts of the minor in the facilities ofM3 Padel Academyand declares that he/she meets the physical conditions necessary for the practice of the sport, fully and expressly exoneratingM3 Padel Academyof any eventuality, setback, difficulty, problem, injury or accident that may occur due to such circumstances.
In the case of emancipated minors, over sixteen (16) years of age, they will be required to provide documentation proving their legal status.
Persons over eighty-five (85) years of age must submit to the reception of the Center, prior to registering as a User, a medical certificate issued by a registered physician certifying that the person is fit to practice physical exercise in a center such asM3 Padel Academy.
- Physical condition of the Users
Exercising may involve certain risks. Therefore, when using the facilities ofM3 Padel AcademyThe User must evaluate for himself what he can and cannot do. Thus, the User certifies that he is in good physical condition, that his state of health is suitable for the practice of physical activity and exempts from all responsibility for any accident, eventuality, setback, difficulty, problem or injury that may occur due to such circumstance, fully and expressly exoneratingM3 Padel Academy, its employees and directors from any liability for these concepts in the activities and facilities of the Center.
The User declares that he/she is not aware of any medical or other reason why he/ she may not be able to engage in active or passive exercise and that such exercise will not be detrimental to the health, safety, comfort or physical condition of other Users.
The User will not use any of the Center’s facilities if he or she suffers from any infectious or contagious disease or illness, or if he or she has cuts, scratches, open wounds, sores or minor infections, there being a risk that such use may be detrimental to the health, safety, comfort, or physical condition of other Users.
It is important and essential that if a User notices any discomfort or abnormality while exercising, they should stop their activity and consult a doctor. It is recommended to carry out regular medical check-ups to monitor their physical and health condition.
In exceptional cases of possible disease contagion, the protocols and measures provided and recommended by the competent authorities in Public Health would be applied, such as taking body temperature.
before accessing the centres or those generic measures that, for prevention, the health authorities consider appropriate at any given time.
Notwithstanding the foregoing,M3 Padel Academyhas contracted with a civil liability insurance company.
- Online contracting procedure
The User, after reading these General Conditions and accepting them, and providing the data requested in the registration form, may contract the service through the Web, by clicking on the “[PLACE ORDER]” button.
In any case, verification of the terms of the order will be the sole responsibility of the User and the purchase process cannot be started until the User has sent confirmation of the terms of the order.
All receipts will preferably be made by credit card or bank transfer.
The final full price, including VAT, of each Service that can be contracted through the aforementioned platform is reported on the Website.
Likewise, where applicable, the full final price will be reported, breaking down, where applicable, the amount of any applicable increases or discounts and the costs passed on to the User.
If at the time of issuing the invoice, the User has not been charged by bank card or the bank transfer has not been successful as indicated above, it will be considered an unpaid receipt.
Expenses incurred by refunds of bank card receipts will be borne entirely by the User.
Failure to pay a receipt will result in not being able to access the experience in M3 Padel Academy.
- RULES OF USE AND OPERATION
- Right of access to facilities
Registration is personal, cannot be assigned or transferred and its amount is not refundable. Therefore, the Centre reserves the right to request proof of User status from anyone in the Centre when entering or leaving the facilities.
Any User shall be responsible for using the Centre, facilities and different areas of the centre with due diligence and care.
- Right of admission and causes of expulsion
The address of theM3 Padel AcademyThe corresponding authority may suspend, temporarily or permanently, or by expulsion, the right of access to users ofM3 Padel Academy, when any of the following circumstances occur: (i) Persons who display violent attitudes, or who publicly incite hatred, violence or discrimination, who behave aggressively or provoke disturbances and who, in general, disturb public order; (ii) Persons who carry weapons or objects that could be used as such;
- Persons who wear clothing or symbols that incite violence, racism or xenophobia, in the terms provided for in the Criminal Code; (iv) Persons who may cause danger or inconvenience to other persons and, in particular, those who are consuming drugs or narcotic substances or show symptoms of having consumed them, and those who show obvious signs of intoxication; (v) Persons who bring animals into the centre, with the exception of guide dogs; (vi) Persons who show external signs of suffering from an infectious or contagious disease; (viii) Persons who do not display minimum hygiene conditions; (ix) Persons who do not wear appropriate sports clothing or footwear in accordance with the sporting activity carried out; (x) Persons who cause damage to the image or honorability ofM3 Padel Academy, its Users or Personnel; (x) Persons who cause moral or material damages of great relevance to theM3 Padel Academy(xi) Persons acting againstM3 Padel Academy(xii) Persons who offend the sensibilities or violate the privacy and/ or property rights of other Users; (xiii) Persons who carry out unfair behavior or practice, practice any type of trade or business of products or services with other Users or Personnel, which is in direct or indirect competition with the User; (xiv) Persons who commit acts of malpractice or who commit acts of fraud or other misconduct, …M3 Padel Academy; (xiv) Persons who have carried out any action or omission classified as a crime or misdemeanor in the Penal Code; (xv) Persons who do not have the corresponding subscription to the one they intend to access; (xvi) Persons who fail to comply or have previously failed to comply with these General Conditions or any other internal or general regulations, as well as for not following the instructions of the Center’s Staff.
Thus, the occurrence of any of the aforementioned circumstances may be cause for expulsion, lead to the suspension of the right of access and the loss of the status of User, and may also prevent registration or re-registration, during the period set or permanently, depending on the seriousness of the offence committed, at the discretion of the management of M3 Padel Academy.
The imposition of the expulsion sanction does not exempt the offender from the obligation to compensate for any damages or losses caused to M3 Padel Academy.
In order to maintain order, security and the provisions of the rules and regulations of use, the staff of the Center (the “Staff”) is authorized to give the corresponding instructions, which must be followed and respected at all times.
In the event that the User has any complaint regarding the members of the Staff, he/she must express it personally, in person, in writing or electronically, by contacting the address of theM3 Padel Academy corresponding.
The User knows and accepts that: (i) he/she will observe the rules of conduct of the Center and, specifically, of each space where there are specific ones, in order to respect and not hurt the sensitivity or privacy of other users, and undertakes to maintain civil and respectful behavior with other users and with the Staff.M3 Padel Academy, since their actions and/or omissions are not contrary to any applicable regulations, nor to morality or public order; (ii) they will refrain from carrying out imprudent or negligent acts that may cause damage or injury, both to the User and to the rest of the personnel, facilities or materials of the M3 Padel Academy that corresponds, being fully responsible for the consequences that may arise from the non-compliance of these obligations, even committing to pay the full amount corresponding to the cost of the replacement or repair of damages or defects caused to the facilities or materials ofM3 Padel Academythat applies when there is negligence in use;
M3 Padel Academyshall not be liable for failure to comply with the above, and any consequences that may arise shall be the full responsibility of the person who fails to comply with the above.
- Contractual and legal provisions
So much M3 Padel AcademyAs the User, they undertake to comply with these General Conditions with diligence and good faith and under the terms established in this contract.
Notwithstanding the foregoing,M3 Padel Academywill respond to the Users in accordance with the terms established in the applicable legislation in force at all times.
For the purposes of the provisions of Article 18 of the Constitution and Organic Law 1/1982, of May 5, on Civil Protection of the Right to Honor, Personal and Family Privacy and One’s Own Image. The User gives his consent and authorizes M3 Padel Academyto commercial use of the personal data provided and images in which the User may appear, within the commercial relationship with the company and in order to be published on the website, social networks, commercial filming and photographs for magazines or publications related to the sector without the right to compensation. Otherwise, the User must express his or her will in writing.
Without prejudice to the other provisions contained in these General Conditions, Users accept and assume that neitherM3 Padel Academy, nor its Personnel, shall be liable for: (i) any loss, damage or theft of personal items of any kind belonging to Users; (ii) any damage or defect caused by Users to the Center’s facilities or its equipment or materials; (iii) any personal damage or injury suffered by Users when not derived from an action or omission required by the Center M3 Padel Academy.
- Ineffectiveness of certain provisions
In the event that any of the provisions of this contract should be deemed wholly or partly ineffective or unenforceable, its remaining provisions shall not be affected by the partial invalidity.
- Identification for communications purposes
The User must direct any communication or claim related to this contract to the attention and address indicated in the heading of these General Conditions or by sending an email to the email address: info@m3padelacademy.com
Any difference, dispute or litigation that may arise from the provisions of this contract or arise from its execution will be resolved by the Courts and Tribunals established according to current legislation.
