The terms and conditions set forth below (the \u201cGeneral Conditions\u201d) regulate the relationship between the companyM3 SPORTS & COACHING, L., withCIF B86724937 and address inDelco Street 5, Leganes, 28915, Madrid (Spain), in particular in relation to its sports programme activity International Padel Week and International Padel Week-end in M3 Padel Academy(hereinafter collectively referred to as \u201cUser\u201d).<\/span><\/p>\n All persons who have a formal contract with the company will be considered users. M3 Padel Academy, the object of which is the paid use of the services offered by M3 Padel Academy (the \u201cServices\u201d).<\/span><\/p>\n Acceptance of this document implies that the User: (i) has read, understands and comprehends these General Conditions; (ii) is a natural person with sufficient capacity to contract and meets the legal conditions to enter into the contract carried out through the Web; (iii) assumes each and every one of the obligations established herein, which will regulate this purchase process, and (iv) understands and accepts the rules of use and operation of<\/span>M3 Padel Academy<\/span>(included in this document).<\/span><\/p>\n Registration implies acceptance of the rules and regulations of use established by <\/span>M3 Padel Academy.<\/span><\/p>\n The User knows and accepts the content of these General Conditions established, and that non-compliance with them, or any other internal or general regulations that may be applicable, or indication made by the Staff of<\/span>M3 Padel Academy<\/span>, may lead, as a consequence, to the discharge and expulsion of <\/span>M3 <\/span>Padel Academy.<\/span><\/p>\n The quality of User ofM3 Padel AcademyIt is obtained by formalizing the registration and making the payment for the experience.<\/span><\/p>\n Registration as a User of<\/span>M3 Padel Academy<\/span>covers the contractual relationship for the period for which the receipt is paid.<\/span><\/p>\n The User knows and accepts that<\/span>M3 Padel Academy<\/span>may establish and\/or modify limitations on the registration of persons in the Center.<\/span><\/p>\n You can register at<\/span>M3 Padel Academy<\/span>Those who prove to be over sixteen (16) <\/span>years old.<\/span><\/p>\n Unemancipated minors over sixteen (16) years of age may register and use the facilities under the following conditions:<\/span><\/p>\n In the case of emancipated minors, over sixteen (16) years of age, they will be required to provide documentation proving their legal status.<\/span><\/p>\n Persons over eighty-five (85) years of age must submit to the reception of the Center, prior to registering as a User, a medical certificate issued by a registered physician certifying that the person is fit to practice physical exercise in a center such as<\/span>M3 Padel Academy.<\/span><\/p>\n Exercising may involve certain risks. Therefore, when using the facilities of<\/span>M3<\/span> Padel Academy<\/span>The User must evaluate for himself what he can and cannot do.<\/span> Thus, the User certifies that he is in good physical condition, that his state of health is suitable for the practice of physical activity and exempts from all responsibility for any accident, eventuality, setback, difficulty, problem or injury that may occur due to such circumstance, fully and expressly exonerating<\/span>M3 Padel<\/span> Academy<\/span>, its employees and directors from any liability for these concepts in the<\/span> activities and facilities of the Center.<\/span><\/p>\n The User declares that he\/she is not aware of any medical or other reason why he\/ she may not be able to engage in active or passive exercise and that such exercise will not be detrimental to the health, safety, comfort or physical condition of other Users.<\/span><\/p>\n The User will not use any of the Center’s facilities if he or she suffers from any infectious or contagious disease or illness, or if he or she has cuts, scratches, open wounds, sores or minor infections, there being a risk that such use may be detrimental to the health, safety, comfort, or physical condition of other Users.<\/span><\/p>\n It is important and essential that if a User notices any discomfort or abnormality while exercising, they should stop their activity and consult a doctor. It is recommended to carry out regular medical check-ups to monitor their physical and health condition.<\/span><\/p>\n In exceptional cases of possible disease contagion, the protocols and measures provided and recommended by the competent authorities in Public Health would be applied, such as taking body temperature.<\/span> before accessing the centres or those generic measures that, for prevention, the health authorities consider appropriate at any given time.<\/span><\/p>\n Notwithstanding the foregoing,<\/span>M3 Padel Academy<\/span>has contracted with a civil liability insurance company.<\/span><\/p>\n The User, after reading these General Conditions and accepting them, and providing the data requested in the registration form, may contract the service through the Web, by clicking on the \u201c[PLACE ORDER]\u201d button.<\/span><\/p>\n In any case, verification of the terms of the order will be the sole responsibility of the User and the purchase process cannot be started until the User has sent confirmation of the terms of the order.<\/span><\/p>\n All receipts will preferably be made by credit card or bank transfer.<\/span><\/p>\n The final full price, including VAT, of each Service that can be contracted through the aforementioned platform is reported on the Website.<\/span><\/p>\n Likewise, where applicable, the full final price will be reported, breaking down, where applicable, the amount of any applicable increases or discounts and the costs passed on to the User.<\/span><\/p>\n If at the time of issuing the invoice, the User has not been charged by bank card or the bank transfer has not been successful as indicated above, it will be considered an unpaid receipt.<\/span><\/p>\n Expenses incurred by refunds of bank card receipts will be borne entirely by the User.<\/span><\/p>\n Failure to pay a receipt will result in not being able to access the experience in <\/span>M3 <\/span>Padel Academy.<\/span><\/span><\/p>\n <\/span><\/p>\n This Cancellation and Return Policy<\/strong> regulates the conditions applicable when a person who has contracted an M3 Padel Academy experience<\/strong> cannot participate in it, requests to modify the dates initially booked or any other circumstance that affects their participation occurs.<\/p>\n This Policy is applicable to all experiences, programmes, services and associated products marketed or managed by the M3 Padel Academy International Area, without prejudice to the particular conditions that, where appropriate, may be established for certain products or services.<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n <\/p>\n 1. CANCELLATION BY THE CLIENT<\/strong><\/p>\n The M3 Padel Academy experiences are organized for certain dates and require the prior planning of coaches, courts, groups, sports services and, where appropriate, accommodation, catering, transport and other additional services.<\/p>\n For this reason, in general, the amounts paid by the customer will not be refundable in the event of cancellation for reasons attributable to the customer<\/strong>, without prejudice to those cases in which the refund is legally required.<\/p>\n However, M3 Padel Academy offers the possibility of keeping the amount paid by issuing a voucher<\/strong>, under the terms established below.<\/p>\n <\/p>\n 2. CANCELLATIONS COMMUNICATED IN ADVANCE<\/strong><\/p>\n When the client communicates the cancellation of their experience fifteen (15) or more calendar days before<\/strong> the scheduled start date, M3 Padel Academy may issue a voucher for the amount paid corresponding to the cancelled experience.<\/p>\n The bonus:<\/strong><\/p>\n The use of the voucher will be subject to availability and the current conditions and prices of the experience you wish to contract at the time of making the new booking.<\/p>\n <\/p>\n 3. USE OF THE BONUS AND CHANGE OF EXPERIENCE<\/strong><\/p>\n When, in accordance with this Policy, M3 Padel Academy issues a voucher in favour of the client, said voucher will be issued for the economic amount recognised to the client corresponding to the experience or service not enjoyed<\/strong>, and will not be linked to the experience originally contracted.<\/p>\n The amount available in the voucher may be used to contract any experience, program, service or associated product available from the International Area of M3 Padel Academy<\/strong>, subject to availability and the conditions and prices in force at the time the new reservation is made.<\/p>\n Consequently, the issuance of a voucher does not imply the maintenance or freezing of the price of the experience initially contracted<\/strong>, but the recognition of an economic balance for the amount that appears in the voucher itself.<\/p>\n When the client uses the bonus:<\/p>\n The subsequent modification of the prices of the experiences or products of M3 Padel Academy will not alter the economic value of the voucher<\/strong>. Therefore, if at the time of using it the price of the chosen experience has increased, the customer must pay, if applicable, the corresponding difference.<\/p>\n Any substitution of one experience for another will be subject to availability and must be expressly confirmed by M3 Padel Academy.<\/p>\n The balance of the voucher will not be exchangeable for money nor will it give the right to a refund, except in those cases in which the refund is legally required. <\/strong><\/p>\n <\/strong><\/p>\n 4. EXCEPTIONAL CIRCUMSTANCES<\/strong><\/p>\n M3 Padel Academy is aware that exceptional circumstances may occur that prevent the client from carrying out the contracted experience.<\/p>\n Therefore, the following situations may be especially assessed, among others:<\/p>\n The above assumptions are merely indicative and do not constitute a closed list<\/strong>. M3 Padel Academy may analyse other exceptional situations taking into account the specific circumstances of each case and the documentation provided.<\/p>\n Where appropriate, M3 may offer the customer a change of dates, a voucher or other reasonable solution in the circumstances, without prejudice to those rights that correspond to the customer under the applicable regulations.<\/p>\n <\/p>\n 5. EXCEPTIONAL EXTENSION OF THE BONUS<\/strong><\/p>\n In general, the vouchers will be valid for a maximum of one (1) year from the date initially scheduled for the experience.<\/p>\n However, where there are duly justified exceptional circumstances that reasonably prevent the voucher from being used within that period, such as a prolonged recovery injury or an extraordinary situation that significantly affects the ability to travel, the customer may request an extension of its validity period.<\/p>\n The application will be assessed by M3 Padel Academy according to the specific circumstances of the case. Any extension must be expressly confirmed by M3 Padel Academy.<\/p>\n <\/p>\n 6. CANCELLATIONS LESS THAN 15 DAYS IN ADVANCE<\/strong><\/p>\n When the cancellation is communicated less than fifteen (15) calendar days before the start date of the experience, there will generally be no automatic right to the issuance of a voucher or to a refund of the amount paid<\/strong>.<\/p>\n However, when there is a duly justified exceptional circumstance, M3 Padel Academy may study the case individually and offer, when appropriate, an alternative taking into account the cause of the cancellation, the advance of the communication, the services already contracted or committed and other concurrent circumstances.<\/p>\n <\/p>\n 7. NO SHOW OR ABANDONMENT OF THE EXPERIENCE<\/strong><\/p>\n Failure of the client to attend on the scheduled date, voluntary abandonment of the experience once it has begun, or decision not to participate in any of the included activities will not result in the automatic issuance of a voucher<\/strong>.<\/p>\n This includes those cases in which the client, for personal reasons or by their own decision, decides not to continue with the contracted program.<\/p>\n However, if once the experience has started there is an injury, illness, emergency or other duly justified exceptional circumstance that prevents the continuation of the program, M3 Padel Academy may analyze the case and assess the issuance of a voucher corresponding to the part of the experience that could not be enjoyed.<\/p>\n <\/p>\n 8. LEVEL OF PLAY AND ORGANIZATION OF GROUPS<\/strong><\/p>\n In those experiences that include group training, M3 Padel Academy will organize the participants taking into account, among other criteria, their sporting level, characteristics of the group and organizational needs of the program.<\/p>\n The technical team may make the adjustments it deems reasonably necessary to provide the player with the training that best suits his characteristics.<\/p>\n When, for technical or sporting reasons, the customer is proposed to participate in sessions, groups or programmes different from those initially planned, such adaptation will not in itself lead to the creation of a voucher, nor to the total or partial refund of the price<\/strong>.<\/p>\n If the change involves a relevant modification of the contracted services, M3 Padel Academy will analyse the circumstances of the case and propose an appropriate solution.<\/p>\n <\/p>\n 9. SERVICES NOT USED BY THE CUSTOMER’S DECISION<\/strong><\/p>\n Voluntary absence from training, theoretical classes, video-analysis sessions, physical activities, meals, treatments, travel or other services included in the experience will not give the right to request its economic valuation independently or to claim the refund of the corresponding proportional part. The above is without prejudice to those exceptional cases in which M3 Padel Academy considers it appropriate to adopt another solution or the rights that legally correspond to the client.<\/p>\n <\/p>\n 10. CHANGE OF DATES<\/strong><\/p>\n When the client is unable to attend on the dates initially contracted, they may contact M3 Padel Academy to request a change of dates in compliance with the provisions of this Policy.<\/p>\n The possibility of making the change will be subject to the advance notice with which it is requested, the existing availability, the characteristics of the contracted experience, the services already committed and the other circumstances of the case.<\/p>\n The request for change will not imply automatic acceptance. Any modification of dates must be expressly confirmed by M3 Padel Academy.<\/p>\n <\/p>\n 11. CANCELLATION OR MODIFICATION BY M3 PADEL ACADEMY<\/strong><\/p>\n If M3 Padel Academy is forced to cancel an experience or make a substantial modification to the contracted services, it will inform the client as soon as reasonably possible and offer the appropriate alternatives in view of the specific circumstances.<\/p>\n When it is not possible to provide the contracted experience or offer an acceptable alternative, the corresponding solutions and, where appropriate, reimbursements will be applied in accordance with the applicable regulations.<\/p>\n <\/p>\n 12. ACCOMMODATION, TRANSPORTATION AND SERVICES PROVIDED BY THIRD PARTIES<\/strong><\/p>\n When the booking includes accommodation, transport or other services provided by third parties, any modification or cancellation may also be conditioned by the conditions applicable to the corresponding service and by the costs that M3 Padel Academy has assumed or committed to said suppliers.<\/p>\n M3 Padel Academy will inform the client, when necessary, of the consequences that such services may have on their request for cancellation or modification.<\/p>\n The foregoing is always without prejudice to the rights that correspond to the customer in accordance with the applicable regulations.<\/p>\n <\/p>\n 13. HOW TO REQUEST A CANCELLATION OR CHANGE<\/strong><\/p>\n Any request for cancellation, change of dates, change of experience, issuance of a voucher or extension of its validity period must be made by email to the following address:<\/p>\n experiences@m3padelacademy.com<\/strong><\/p>\n For the purposes of this Policy, email will be the formal channel enabled by M3 Padel Academy for the submission and management of these requests, allowing a record of both their content and the date on which they have been communicated.<\/p>\n The application must indicate at least:<\/p>\n <\/p>\n 14. ACCEPTANCE OF THE POLICY<\/strong><\/p>\n Contracting an experience means that the customer has had access, before formalising their purchase, to this Cancellation and Return Policy and has been able to know and understand its conditions.<\/p>\n Acceptance of this Policy will form part of the conditions of contracting the experience. In the case of underage participants, their acceptance must be made by the father, mother or legal guardian when necessary.<\/p>\n <\/p>\n 15. CONSUMER RIGHTS<\/strong><\/p>\n This Policy sets out the general terms and conditions for cancellation and modification of M3 Padel Academy experiences.<\/p>\n None of its provisions shall be intended to exclude, limit or prejudice those rights that correspond to the customer and that are mandatory in accordance with consumer and user regulations or any other applicable regulations.<\/strong><\/p>\n In the event of a contradiction between this Policy and a mandatory legal provision, the latter shall prevail.<\/p>\n <\/p>\n 16. PRIVATE LESSONS <\/strong><\/p>\n Private classes are reserved for a specific date and time<\/strong>, involving the assignment and prior planning of the coach, court and other resources necessary for their provision.<\/p>\n For this reason, in general, the amounts paid for private classes will not be refundable when the cancellation is attributable to the client<\/strong>, without prejudice to the exceptions provided for in this section and the rights that may legally correspond to them.<\/p>\n When the client requests the cancellation or modification of a private class more than twenty-four (24) hours before<\/strong> the scheduled time for its celebration, he or she may request:<\/p>\n When the cancellation or modification is communicated twenty-four (24) hours or less in advance<\/strong>, or the client does not show up for the class on the date and time reserved, there will generally be no right to modify the reservation, obtain a voucher or request a refund of the amount paid.<\/p>\n However, when duly justified exceptional circumstances<\/strong> occur, such as a situation of force majeure, injury, illness or other circumstance of a similar nature that makes it reasonably impossible for the client to attend, M3 Padel Academy may analyse the specific case and, when appropriate, authorise a change of date or issue a voucher.<\/p>\n When the private class has been contracted twenty-four (24) hours or less in advance of its celebration, it may not be subject to modification nor will it entitle, in general, to the issuance of a voucher when the impossibility of attending is attributable to the client, without prejudice to duly justified exceptional circumstances that may be assessed by M3 Padel Academy.<\/p>\n If the private class cannot be held for a reason attributable to M3 Padel Academy,<\/strong> the client will be offered, as appropriate, a new date for its realization or the refund of the amount paid, without prejudice to any other right that may correspond to him in accordance with the applicable regulations.<\/span><\/p>\n <\/span><\/p>\n Registration is personal, cannot be assigned or transferred and its amount is not refundable. Therefore, the Centre reserves the right to request proof of User status from anyone in the Centre when entering or leaving the facilities.<\/span> Any User shall be responsible for using the Centre, facilities and different areas of the centre with due diligence and care.<\/span><\/p>\n\n

<\/strong>When the client is unable to travel to Spain as a result of the refusal of a visa necessary to make the trip, they must provide official documentation that proves such refusal.<\/li>\n
<\/strong>When an injury, illness or other medical circumstance reasonably prevents the client from participating in the experience, sufficient medical evidence must be provided.<\/li>\n
<\/strong>M3 Padel Academy may assess those serious, unforeseeable situations or beyond the control of the client that make it impossible or especially difficult for them to travel or participate, such as armed conflicts, travel restrictions, serious family events or other circumstances of a similar nature.<\/li>\n<\/ol>\n<\/ol>\n
